Terms of Use

1. Agreement

These Terms of Use ("Terms") govern your access to and use of SimpleWhats(the "Service"). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. The Service (send-only)

SimpleWhats provides an API for sending outbound WhatsApp messages (text and media) from WhatsApp accounts you connect. The Service is send-only: it does not receive, read, ingest, or store inbound messages sent to your connected accounts by their contacts.

3. Not affiliated with WhatsApp

SimpleWhatsis an independent service and is not endorsed by, affiliated with, or sponsored by WhatsApp LLC or Meta Platforms, Inc. Your use of connected WhatsApp accounts must comply with WhatsApp's own Terms of Service. You are solely responsible for how you use WhatsApp through the Service, and you acknowledge that WhatsApp may restrict or ban accounts at its discretion. SimpleWhats is not liable for any such action.

4. Acceptable use

You agree not to use the Service to:

• send spam, unsolicited bulk messages, or messages to recipients who have not consented;
• send unlawful, fraudulent, harassing, deceptive, or infringing content;
• violate any applicable law, including anti-spam, data-protection, and telemarketing rules;
• exceed the message quotas or rate limits of your plan, or attempt to circumvent them.

You are responsible for obtaining all consents required to message your recipients and for the content of every message you send.

5. Message content

By default, SimpleWhats stores only metadata about the messages you send (such as recipient, timestamp, and delivery status) and does not retain the message body. You may optionally enable content storage per connection. You are responsible for the lawfulness of any content you choose to have stored.

6. Plans, billing, and no refunds

Paid plans are billed in advance on the billing cycle you select (monthly, quarterly, or annual). All payments are non-refundable. We do not provide refunds or credits for partial billing periods, unused messages, downgrades, or cancellations. You may cancel at any time; cancellation stops future renewals but does not entitle you to a refund of amounts already paid. We may change pricing on a prospective basis.

7. Free trial

The free trial permits a limited total number of messages and is subject to rate limits. Trial limits may change, and we may end or modify the trial at any time.

8. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that messages will be delivered, that the Service will be uninterrupted or error-free, or that connected accounts will remain active.

9. Limitation of liability

To the maximum extent permitted by law, SimpleWhats and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the three months preceding the claim.

10. Termination

We may suspend or terminate your access if you violate these Terms or if required to protect the Service or comply with law. Amounts already paid remain non-refundable.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
